Booking Conditions

These are the booking conditions applicable to holidays booked with SunDesk S.A.R.L. AU and should therefore be read carefully. Should any part of these conditions become invalid or unenforceable this will not affect the validity of the remainder of these conditions.

Holiday Contract

Your contract is with SunDesk S.A.R.L. AU, Rue Tasga Oudrar No. 31, Taghazout 80022, Agadir. The person signing the booking form must read and accept these booking conditions. In the case of a group booking the group leader or « lead name » must have the authority to sign on behalf of everyone in the group. The lead name will be responsible for the full cost of the holiday including insurance premiums, cancellations and amendment charges. No booking contract exists between SunDesk S.A.R.L. AU, and the client until the booking form has been received. We reserve the right to refuse to accept bookings in our absolute discretion without stating the reason for doing so. Please inform us immediately if there are any discrepancies in the costs or details of your booking.

Prices 

All prices are in Euro unless otherwise stated. Upon making your booking the price of your holiday will not normally be subject to change, however we reserve the right to increase or decrease prices due to variations in service charges, insurance/security levels or exchange rates. Once a booking has been made discounts cannot be applied retrospectively. 

Cancellation of holiday by SunDesk S.A.R.L. AU clients

If you are obliged to cancel your booking you should write to SunDesk S.A.R.L. AU immediately. Refunds of deposits for cancellations are as follows:  

Cancellation Policy:

4 weeks or more from holiday start date = Full refund
1 – 4 weeks before holiday start date = 50% refund
Less than 1 week to holiday start date = No refund

Free cancellation is provided in case of border closure. 

Free rebooking is provided in case of a Coronavirus infection or mandatory quarantine.

If the booking is changed more than 28 days prior to the course, SunDesk S.A.R.L. AU will make every effort to change the requested booking. Less than 28 days prior to the start, no changes can be made.

 

Cancellation of holiday by SunDesk S.A.R.L. AU 

SunDesk S.A.R.L. AU reserves the right in any circumstance to cancel your holiday. However, in no case will we cancel your holiday less than 8 weeks before the scheduled departure except for reasons of ‘force majeure’ which include war, political unrest, strikes, acts of God, epidemics, natural and technical disaster, closure of ports and aircraft or unless the clients default in the payment of the balance of the holiday price. In circumstances where we are unable to provide the holiday you have booked we will return to you all monies paid, or offer you an alternative holiday of similar standard.

Alterations to your holiday by SunDesk S.A.R.L. AU: It is unlikely that we will have to make any changes to your holiday, but occasionally small changes may be made, which we reserve the right to do at any time. Most of these changes are minor and we will advise you at the earliest possible date.

Our contract with you is deemed to be made at the offices of SunDesk S.A.R.L. AU, Rue Tasga Oudrar No. 31, Taghazout 80022, Agadir. All our conditions are subject to Moroccan Law. 

General: SunDesk S.A.R.L. holidays start and finish where stated on your invoice or booking confirmation. We are not responsible for your travel to or from this point or for any expenses, including travel accommodation, subsistence and loss of earnings, caused by delayed return to your departure point, howsoever caused. 

Airport transfers: It may sometimes be necessary to combine, on certain transfers, customers arriving or departing on more than one flight, which may require additional waiting time at your airport or accommodation. Sometimes our airport transfers are contracted to a local agency. Please note departure times are 3hrs prior to your flight departure from you. 

Group Bookings 

1. Groups are defined as being an organised official group having a constitution or memorandum and articles and comprising of 5 or more people. These ‘Groups’ are subject to the standard group terms and conditions. If a Group of less than 5 people book through the Contact Centre or the website they will be subject to non-Group Family and Individual terms and conditions and will have to make full payment at the time of booking. 

2. Group booking will have a nominated group leader, who is responsible for making and overseeing the booking, including financial and legal responsibility.  

3. Group leaders accompanying the Group are responsible for the safeguarding, discipline and behaviour of their Group. Group leaders are responsible for all damage caused by their action or inaction, or the actions or inactions of those in their Group.   

4. Groups shall not offer for sale to the general public (or publicly advertise the sale of) SunDesk S.A.R.L facilities or services without the prior written agreement of SunDesk S.A.R.L.  

5. Sole use of the hostel may be offered but will be subject to explicit agreement at the time of booking. Unless specifically highlighted in the confirmation, such guests will not be entitled to, nor should they expect sole-use of the hostel, wing, section or grounds of a given property. In the case of booking a hostel on a sole-usage basis, customers may be asked to pay for a minimum number of beds or be charged an additional supplement. These conditions will be agreed and confirmed at the time of the initial booking; sole-usage will not be guaranteed should the number of paying guests reduce below the agreed minimum number at a later date. If sole use is released, any sole use supplements or surcharges are subject to cancellation fees set out in Clause 8.  

6. A booking for sole use of a property is entered into on the understanding that the total number in your party shall not exceed the total number of beds available at the hostel. You must seek special permission from us in writing before booking, if you wish to hold any kind of event where the number of guests exceeds the bed capacity and/or you wish to bring any additional equipment or temporary accommodation to the site (including additional cooking equipment, tents, marque, gazebos or similar). We reserve the right to terminate the hire immediately should this be taking place without our prior written consent.                                               

 

7. Group Bookings – Payments 

7.1 Payments shall be made in such format as we agree with you when you place an order.  

7.2 In order for us to confirm your Booking you must pay us the appropriate sum as set out in the terms below: 

7.3 Group Bookings made more than 12 weeks (84 days) in advance of arrival date. A provisional booking can be held for up to a maximum of 21 days without payment. To confirm a booking an initial deposit of 25% of the total booking value is required. Your first deposit payment will confirm the acceptance of the group booking terms and conditions stated in this document. Full balance is due 8 weeks (56 days) before arrival. 

7.4 Group Bookings made within 12 weeks (84 days)of arrival date. A provisional booking can be held for up to a maximum of 7 days without payment. The total booking value should be paid at least 8 weeks (56 days) before arrival.  

7.5 SunDesk S.A.R.L will require you to confirm final group numbers no later than 8 weeks (56 days) prior to arrival. 

7.6 SunDesk S.A.R.L will, where applicable, send you an invoice for all payments at least two weeks (14 days) before the payment due date, based on the latest guest numbers provided. If payment is overdue at any stage, YHA reserves the right to remove any free leader places, discounts or eligibility for exclusive hostel usage or cancel your booking. 

7.7 If any payment under these terms and conditions is overdue, then without prejudice to our other rights and remedies we may cancel your Booking and / or we may suspend the supply and / or deliveries of any other services being provided to you by SunDesk S.A.R.L. 

7.8 Room Supplements: At our Hostel we have a number of rooms that are ideally suited for group bookings. If you wish to book specific room types, we will offer you the closest matching room option but will normally charge an additional Room Supplement.

Holiday Termination and Indemnity

 

While staying with SunDesk S.A.R.L. AU clients are expected to behave in an orderly and acceptable manner and are expected to accept responsibility for the conduct of themselves and their party. Should their behavior threaten the condition of the accommodation or vehicles or seriously impair the enjoyment of other guests, SunDesk S.A.R.L. AU reserves the right to refuse to further accommodate the guilty party and contractual obligations will be terminated. The guilty party will be liable for the cost of any damage caused.

 

Insurance

 

Everyone booking a holiday with SunDesk S.A.R.L. AU must have full travel insurance. SunDesk S.A.R.L. AU accepts no responsibility for loss theft or damage to persons or property during their stay. Guests must obtain their insurance independently.

If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

In no event shall SunDesk S.A.R.L. These terms and conditions are governed by and construed in accordance with the laws of Morocco and you irrevocably submit to the exclusive jurisdiction of the courts in that State.
